TERMS OF SERVICE AGREEMENT

This Terms of Service Agreement ("Agreement") is a legal agreement between you and TGW Properties, LLC ("TGW," "we," or "us") regarding your use of TGW's website and services, including any forms, tools, communications systems, and SMS messaging services (collectively, the "Services"). Please read this Agreement carefully. By using our website, joining our buyer list, or submitting your property information for review, you agree to be bound by the following terms.

1. Acceptance of Terms

By accessing or using the Services, you represent that you have read, understood, and agree to be bound by this Agreement. If you do not agree with these Terms, do not use the Services. If you are using the Services on behalf of an organization, you must have the authority to bind that organization to these Terms.

2. Updates to Terms

TGW may update these Terms from time to time. The "Effective Date" at the top of this page indicates when the latest changes were made. Your continued use of the Services after changes are posted means you accept those changes.

3. Use of the Services

TGW Properties connects with individuals interested in:

• Selling residential properties to TGW
• Receiving real estate deal opportunities in Missouri and Illinois

You agree to use our Services only for lawful purposes. You may not use our Services to:

• Submit false or misleading property details
• Impersonate another person or misrepresent your affiliation
• Copy, scrape, or harvest data without permission
• Attempt to disrupt, damage, or gain unauthorized access to our systems

4. User Submissions

When you submit information to TGW (such as a property address, name, email, or phone number), you grant us the right to contact you regarding your submission. You also affirm that the information you provide is accurate to the best of your knowledge.
We may retain and use your submission internally, in accordance with our Privacy Policy, for evaluation or marketing purposes.

5. SMS Messaging Terms

1. SMS Consent and Privacy:
   By checking the SMS consent box or otherwise opting in, you consent to receive text messages related to your interactions with TGW Properties LLC. The phone numbers collected as part of the SMS consent process will not be shared with third parties for marketing purposes.

2. Types of SMS Communications:
   If you have consented to receive text messages from TGW Properties LLC, you may receive messages related to the following:

"Message frequency may vary. You may receive up to 4 SMS messages per week regarding properties, appointments, or account status."

4. Potential Fees:
   Standard message and data rates may apply depending on your mobile carrier and plan. These rates may vary by carrier and whether messages are sent domestically or internationally.

5. Opt-In Methods:
   You may opt in to receive SMS messages from TGW Properties LLC through the following methods:

• By submitting an online form

6. Opt-Out Method:
   You can opt out of receiving SMS messages at any time. To do so:

• Reply "STOP" to any message

• Or contact us directly at 314-720-2029 to request removal from our messaging list

7. Help/Support:
   If you need assistance or are experiencing issues, reply with the word HELP.

6. Intellectual Property

All content on the website, including logos, text, graphics, forms, and layout, is the property of TGW Properties or its licensors. You may not copy, modify, distribute, or create derivative works from any content without prior written consent.

7. No Guarantees or Warranties

The Services are provided "as is" without any warranties, express or implied. TGW does not guarantee the availability of any deal, the condition of any property, or the outcome of any transaction.

8. Limitation of Liability

To the maximum extent permitted by law, TGW Properties is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim under this Agreement shall not exceed one hundred dollars ($100).

9. Third-Party Links

The Services may include links to third-party websites or services. TGW is not responsible for the content, policies, or practices of third-party sites. Use them at your own risk.

10. Termination

We reserve the right to terminate or suspend your access to the Services at our sole discretion, without notice, if we believe you have violated these Terms.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of laws rules.
